A Guide to Property Conveyancing in Kenya
Property conveyancing in Kenya is the legal process of transferring ownership of land or property from one person to another. It is governed primarily by the Land Act, 2012, and the Land Registration Act, 2012.
The Conveyancing Process
The process begins with a formal offer and acceptance, followed by a search at the relevant land registry to verify ownership and ensure there are no encumbrances like charges or caveats.
Key documents required include the original title deed, KRA PIN certificates for both parties, and land rent/rates clearance certificates.
"Due diligence is the most critical step in any land transaction in Kenya."
Once the search is clear, the advocate prepares a Sale Agreement. After execution, the transfer documents are prepared and stamped for duty, and finally, the new owner is registered at the Lands Registry.
